Terms of Service

Welcome to Idea Heist, an AI-powered YouTube idea and packaging tool. The Creator Playbook is a product of John Malecki LLC, a Pennsylvania limited liability company ("we," "us," "our"). By accessing or using the service at idea-heist.creator-playbook.com or idea-heist-app-production.up.railway.app (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. The Service
Idea Heist walks you through building an audience avatar, then generates video ideas, titles, hooks, and thumbnail concepts using AI and proprietary frameworks developed by John Malecki and The Creator Playbook. The Service provides ideas and suggestions but does not guarantee any specific outcome (such as increased views, click-through rate, channel growth, or revenue).
2. Accounts
You may access the Service through Google Sign-In, by creating an email-and-password account, or by entering an access code provided by The Creator Playbook. You are responsible for keeping your credentials secure and for all activity under your account. Notify us at support@creator-playbook.com if you suspect unauthorized use.
3. Plans
- Free plan: 3 heists per month, per user.
- TCP Member plan: Unlimited heists, channels, and idea regenerations. Included with active Creator Playbook membership.
- Pro plan: Planned for future release. Pricing and terms will be posted before any paid plan launches.
- We reserve the right to change plan structure or pricing with at least 30 days' notice to active users.
4. Acceptable Use
You agree not to:
- Upload content that is illegal, infringing, defamatory, or that violates a third party's intellectual-property or privacy rights.
- Attempt to reverse engineer, scrape, or otherwise extract our title patterns, system prompts, scoring logic, or model outputs for resale or competitive use.
- Use the Service to generate content that violates YouTube's policies, platform-specific guidelines, or any applicable law.
- Share your account credentials, or use the Service on behalf of multiple users, to circumvent plan limits.
- Submit URLs or content that you do not have a legitimate creator or research interest in.
5. Your Content
You retain all rights to the avatar profiles, channel descriptions, YouTube URLs, titles, and ideas you submit. By using the Service, you grant us a limited license to process your inputs through third-party AI providers (OpenAI) and the YouTube Data API for the sole purpose of generating your output. We do not sell your data or use your specific inputs to train external models.
6. Source Video Data
When you submit a YouTube URL, we fetch publicly available metadata (title, description, view counts, channel statistics) via the official YouTube Data API. Generated ideas inspired by a source video are yours to use; they do not infringe the source creator's rights because they are independently authored derivatives of public packaging patterns.
7. Intellectual Property
The Idea Heist Framework, our title patterns library, audience avatar builder methodology, system prompts, and all site copy and designs are the property of John Malecki LLC. The ideas, avatars, and outputs generated by the Service are yours to use, but the underlying methodology is not licensed to you.
8. AI-Generated Output
Ideas, titles, hooks, thumbnails, and avatar profiles are generated by AI and may occasionally be incorrect, inconsistent, or incomplete. Use your judgement. We are not liable for decisions you make based on the Service's output, including but not limited to videos you produce, titles you publish, or business decisions based on avatar profiles.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, John Malecki LLC and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of your use of the Service. Our total aggregate liability will not exceed the greater of (a) $100 USD or (b) the amount you paid us in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your access if you violate these Terms, if required by law, or if we stop operating the Service. You may stop using the Service at any time and delete your account by contacting support.
11. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Pennsylvania.
